Under present UK insurance law, you must disclose all
‘material facts’ when applying for any type of insurance policy. This includes
all criminal convictions which are ‘unspent’ under the Rehabilitation of
Offenders Act 1974. It includes the convictions of everyone who will be covered
under the insurance contract, and includes your partner and children, and it
doesn't matter about the type of offence it still has to be disclosed. Non
disclosure will more than likely result in a refusal to pay out on a claim and
void the policy. The onus of responsibility lies with the person to disclose the criminal record, offence or unspent conviction, and not with the insurance company to specifically ask about it. So if the insurance company does not ask about criminal records or convictions at the time of applying for the insurance it will come out at the time of making a claim, and it is then that the insurance becomes void.
